Terms of service

Who we are

Town Member is a trading name of Dimension Warriors Limited, a company registered in England and Wales. Our company number and registered office are in the footer of every page. When we say "we" or "us" we mean Dimension Warriors Limited; when we say "you" we mean the business that signs up.

These terms are a business-to-business agreement. You confirm that you are signing up on behalf of a business and not as a consumer.

You confirm that you own the business, or have its owner's permission to run its website. If that turns out not to be true we will take the site down without notice and close the account; nothing is refunded, and any domain we registered stays with us. Every site we host carries a link for the business's owner to tell us.

What you get

A website for your business, built from information that is already public about it and from what you tell us, hosted by us, and changed on your instruction through WhatsApp. A web address on townmember.com, or your own domain pointed at us. Previews before anything goes live, and the ability to put the site back to an earlier version.

Changes you ask for are made by an automated assistant and checked by you before they are published. Nothing is published to your site without you saying yes. If the assistant cannot do something, a person will.

Price and payment

£49 a month or £490 a year, paid in advance by card or Direct Debit through Stripe. There is no setup fee. We are not VAT registered; if that changes we will tell you at least 30 days before VAT is added and you may cancel before it applies.

Free trial: a new subscription starts with 14 days free, for the website and, if you choose it, table bookings. We take your card at the start so your site carries on without a gap, and we message you at least 3 days before the first payment is taken. Cancel before the trial ends and you pay nothing. During the trial your site uses its free townmember.com address; to use a domain you own, or to have us register one, you can start your subscription early, which ends the trial and takes the first payment that day. One free trial per business.

Optional extras are priced separately and shown before you pay: a set-up session (charged when you buy it, even during a free trial), and table bookings at £29 a month or £290 a year, renewing with your subscription.

If a payment fails we will tell you and try again. If it has not succeeded after 14 days we may pause your site until it does. Your content is kept, as set out under Cancelling.

Cancelling

You can cancel at any time from the billing page, by message or by email, and you will not be charged again. Your site stays up until the end of the period you have paid for.

Payments are not refunded: the free trial is there so you can try the service first and cancel before paying anything. Domain registration fees are never refundable.

If you cancel after paying, your site stays up until the end of the period you have paid for and then pauses. For 90 days after that you can download a copy of your site to keep, every page with its styling and photographs, by asking on WhatsApp, and you can restart your site at any time in that period with everything as it was. After 90 days the site and its content are deleted.

If a free trial ends without a payment, because you cancelled or the first payment did not go through, your site is paused: visitors see only your business's name, phone number and address. It is kept for 30 days in case you restart, then deleted. No copy of the site, its content, its photographs or any other data is provided for a trial that was never paid for; the originals of anything you sent us are already yours.

Your conversation history with us is deleted when your site is, unless the law requires otherwise.

Domains

If you point a domain you already own at us, it stays yours throughout and afterwards.

If we register a domain for you, we do so once your subscription has started (at the end of your free trial, or earlier if you start it early) and your first payment has cleared; until then your site runs on its free address. The domain is included in your subscription while you remain a customer. If you cancel within the first year without a refund you may transfer it to yourself at no charge, or let it lapse. After the first year we renew it only while you subscribe. We will never hold your domain against you.

Your content and your responsibilities

You own the words and pictures on your site. You give us a licence to store, display and change them as needed to run the service.

You are responsible for what your site says. That includes opening hours, prices, allergen information and claims about your business. We will ask before publishing anything we are not sure about.

Images are your responsibility, entirely. You must have the right to use every photograph, logo and picture on your site, whether you sent it to us, we found it online during the build, or it came from anywhere else. Photographs we find online are shown only in your preview, and they go on your live site only after you confirm you have permission to use them. We do not check who owns an image and we cannot do so; by confirming, or by sending us an image, you are telling us you have that permission. If someone claims an image on your site infringes their copyright, that is between you and them: you will deal with it and cover any cost, and we may remove the image from your site while it is sorted out.

You must be entitled to use the WhatsApp number you give us, and you are responsible for the people you allow to send changes from it.

What we are responsible for

We will run the service with reasonable skill and care and aim to keep your site available at all times, allowing for maintenance and events beyond our control.

We are not liable for loss of profit or indirect loss. Our total liability to you in any year is limited to the amount you paid us in that year. Nothing in these terms limits liability that cannot be limited by law.

Data protection

For information about your own business and the people who send us changes, we are the controller and the privacy notice explains what we do.

For information your website visitors give you through your site, such as an enquiry form, you are the controller and we are your processor. In that role we act only on your instructions, keep the information secure, do not pass it to anyone except the suppliers named in the privacy notice, help you respond to requests from individuals, delete or return it when you leave, and tell you promptly of any breach. This is the processor clause required by Article 28 of the UK GDPR.

Changes to these terms

We may change these terms by giving you 30 days' notice by email or WhatsApp. If you do not agree you may cancel before the change takes effect.

Law

These terms are governed by the law of England and Wales and the courts of England and Wales.
